- Filtertek vs. ALARIS Medical Systems
A Needle-Free IV Valve Patent Litigation case in the US District court for the Northern District of Illinois Western Division. I worked for the defense on this case that involved review of documents, testing, pictures, videos, reports, and depositions. I am an inventor of the SmartSite Needle-Free Valve that was assigned to ALARIS so I acted as a Fact Witness for this case. The case was a 2-year case from 2002 to 2004 and was the first medical device expert witness case I worked on in my career.
- White Vs. NP Medical/Baxter Healthcare
This was a liability case that involved the connection of a pressurized nebulizer line to a needle-free IV valve. The result was an injection of air into the patients blood stream causing death. The case was in the Superior Court of New Jersey in Middlesex County. As the medical device expert witness, I worked for the defendant in this case and reviewed documents, performed testing, submitted a report, and was deposed.
- ICU Medical vs. ALARIS Medical Systems
A Needle-Free IV Valve Patent Litigation case in the Superior Court of California, Orange County, Central Justice Center. I worked for the defense on this case that involved review of documents, testing, pictures, videos, making potted samples of parts, reports, and depositions. I am the inventor of the SmartSite Needle-Free Valve that was assigned to ALARIS so I acted as a Fact Witness. The case lasted a little over 2 years between 2004 to 2007. This was a rare case where my client was able to get judgement for inequitable conduct on part of the Plaintiff and was awarded payment of legal fees based on my work on this case.
- Medegen vs. ICU Medical – RyMed vs. ICU and Vygon vs. Rymed
These are both patent litigation cases about needle-free IV valves. The cases also involved unfair marketing and advertising. The cases involved extensive patent review, reports, declaration, and depositions. There were multiple cases in District courts of California and Delaware.
- RTI vs. OMI
This was a patent litigation and trade secret case regarding a safety syringe. The case was heard in the Eastern District of Texas, Tyler Division. I was hired by the defense in this case as the medical device expert witness and performed many tests in my medical lab, potted samples to show features of the devices, took pictures and videos, wrote a report, depositions, and trial testimony. This was one of my first cases where I provided testimony in court and was subjected to cross examination.
The pictures below show two areas of our lab depicting our Class 10,000 clean room hood, microscope, oven, tensile/compression test equipment, and pressure/vacuum test equipment just to name a few. All equipment is calibrated to NIST standards to assure accurate test results.
